1. Acceptance of Terms
By accessing, registering for, or using Axiler's services, including the Context Aware Defence Enforcer (CADE) (the "Services"), you irrevocably agree to be bound by these Terms and Conditions. These Terms constitute a legally binding agreement between you and Axiler.
If you do not agree to these Terms in their entirety, you are strictly prohibited from accessing or using the Services.
Axiler reserves the unrestricted right to amend, modify, or replace these Terms at any time. Such changes shall become effective immediately upon publication. Your continued use of the Services constitutes binding acceptance of the revised Terms.
2. Service Description
Axiler provides enterprise-grade cybersecurity services through its proprietary platform:
Context Aware Defence Enforcer (CADE): A security solution delivering advanced threat detection, DDoS mitigation, real-time monitoring, API security, proprietary threat intelligence, and configurable protection mechanisms.
Axiler reserves the absolute right, at its sole discretion and without liability, to modify, suspend, restrict, or discontinue any aspect of the Services at any time, with or without notice.
3. Lifetime Deal Terms
For Services acquired under a "Lifetime Deal":
- "Lifetime" shall strictly mean the commercial operational lifetime of Axiler as a business entity, and not the lifetime of the user or any third party.
- Access is limited to the core functionality available at the time of purchase, subject to reasonable evolution.
- Axiler reserves the sole and exclusive discretion to modify, replace, or discontinue features after an initial twelve (12) month period.
- Any new, enhanced, or premium features may be offered exclusively as paid add-ons without obligation to include them in Lifetime Deals.
- Support services, including response times and service levels, may be revised, reduced, or restructured at any time, subject to periodic review.
- Lifetime Deals are non-transferable, non-assignable, and non-refundable under all circumstances, except where explicitly required by applicable law or approved in writing by Axiler.
4. Intellectual Property and Confidentiality
All rights, title, and interest in and to the Services—including all software, source code, object code, algorithms, models, designs, documentation, and related materials—are and shall remain the exclusive property of Axiler.
You are strictly prohibited from:
- Reverse engineering, decompiling, disassembling, or otherwise attempting to derive source code
- Copying, reproducing, distributing, sublicensing, or creating derivative works
- Accessing the Services for the purpose of building a competing product or service
- Disclosing or exposing any confidential or proprietary information
You acknowledge that any unauthorized use constitutes a material breach and may result in immediate termination and legal action.
Axiler retains all rights to any improvements, modifications, or derivative works, regardless of user feedback or input.
5. Data Protection and GDPR Compliance
Axiler processes personal data in strict accordance with the General Data Protection Regulation (GDPR) and applicable data protection laws.
- Lawful Basis: Personal data shall only be processed where a valid legal basis exists, including contractual necessity, legal obligation, or legitimate interests pursued by Axiler.
- Data Minimization: Only data strictly necessary for defined purposes shall be collected and processed.
- User Rights: You may exercise your rights of access, rectification, erasure, restriction, objection, and data portability, subject to legal limitations.
- Security: Axiler implements appropriate technical and organizational safeguards to protect personal data against unauthorized or unlawful processing, loss, destruction, or damage.
- International Transfers: Where data is transferred outside the European Economic Area (EEA), Axiler shall implement legally recognized safeguards, including Standard Contractual Clauses or equivalent mechanisms.
- Retention: Personal data shall not be retained longer than necessary, except where retention is required by law or legitimate business purposes.
Nothing in these Terms shall limit or exclude any rights granted under applicable data protection laws.
6. Limitation of Liability
To the maximum extent permitted by applicable law:
- Axiler's total aggregate liability arising out of or in connection with the Services shall be strictly limited to the total amount paid by you in the twelve (12) months preceding the event giving rise to the claim.
- Under no circumstances shall Axiler be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunities.
Axiler expressly disclaims all liability for any loss or damage resulting from:
- Cybersecurity incidents or breaches beyond its reasonable control
- Third-party services, integrations, or dependencies
- Force majeure events, including but not limited to natural disasters, war, terrorism, or infrastructure failures
You acknowledge that these limitations form an essential basis of the agreement and shall apply regardless of the legal theory asserted.
7. Termination
Axiler reserves the right to suspend or terminate your access to the Services immediately, without notice or liability, if you breach these Terms or engage in any activity that may harm Axiler's systems, reputation, or users.
Upon termination, all rights granted to you shall immediately cease, and you must discontinue all use of the Services.
8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the applicable laws determined by Axiler, without regard to conflict of law principles.
You agree that any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts designated by Axiler.
